Reprimand

On August 22, 2022, Brad Holley entered into an informal resolution agreement with the COTNS Investigation Committee requiring that, inter alia, he complete a specified course within six (6) months relating to his communication style. Mr. Holley failed to complete that requirement within the requisite time period. The Committee determined that Mr. Holley’s breach of the agreement constituted professional misconduct. On July 25, 2023, Mr. Holley consented to the imposition of a reprimand and an amended informal resolution agreement requiring him to complete an alternative course, in addition to the publication of this outcome.

Joseph Lower (Reg#: 882)

Reprimand

October 19, 2022

On October 8, 2021, a further complaint was received against Joseph Lower alleging that he breached his May 14, 2021 informal resolution agreement with the College. Pursuant to the terms of the agreement, Mr. Lower’s proof of insurance renewal was due by September 23, 2021. As of October 1, 2021, Mr. Lower had not provided the necessary documentation. Mr. Lower acknowledged that he had not renewed his insurance 30 days in advance of the expiration of his policy as required by the informal resolution. The Committee determined that Mr. Lower’s continued conduct, including repeated breaches and/or lapses, constituted professional misconduct. On October 19, 2022, Mr. Lower consented to the imposition of a second reprimand and entered into a new informal resolution requiring him to: complete a reflective exercise; create a written plan to ensure that there were no further lapses in his professional liability insurance on an ongoing basis; engage in a specific course of personal development to address some of the challenges impacting upon his ability to manage his time; make a payment in partial reimbursement for the College’s expenses in disposing of this matter; and, appear before the Committee to receive a verbal reprimand, in addition to the publication of this outcome.

Joseph Lower (Reg#:882)

May 14, 2021

On December 8, 2020, a complaint was received against Joseph Lower alleging that he had failed to maintain professional liability insurance coverage for a period of 22 days in October 2020, in contravention of the Registration Regulations.  Mr. Lower had similarly allowed his professional liability insurance coverage to lapse for a 24-day period in October 2018.  Following the initial lapse, Mr. Lower entered into an undertaking with the College promising to maintain appropriate insurance coverage.  Mr. Lower breached that undertaking.  Mr. Lower acknowledged that he had allowed his insurance to lapse on two occasions. The Committee determined that Mr. Lower’s conduct, both in practicing without appropriate insurance coverage, and in breaching his undertaking with the College, constituted professional misconduct.  On May 14, 2021, Mr. Lower consented to the imposition of a reprimand and an informal resolution requiring him to provide proof of insurance renewal 30 days in advance of the expiration of his policy for a period of five years, in addition to the publication of this outcome.
